เล่ม ๑๒๙ ตอนที่ ๓๕ ก ราชกิจจานุเบกษา ๒๐ เมษายน ๒๕๕๕ กฎกระทรวง ว่าด้วยการครอบครองและให้มีการครอบครองยาเสพติดภายใต้การควบคุม เพื่อการสืบสวนความผิดตามกฎหมายเกี่ยวกับยาเสพติด พ.ศ. ๒๕๕๕ อาศัยอำนาจตามความในมาตรา ๖ และมาตรา ๘ วรรคสี่ แห่งพระราชบัญญัติวิธีพิจารณา คดียาเสพติด พ.ศ. ๒๕๕๐ อันเป็นกฎหมายที่มีบทบัญญัติบางประการเกี่ยวกับการจำกัดสิทธิ และเสรีภาพของบุคคล ซึ่งมาตรา ๒๙ ประกอบกับมาตรา ๓๓ มาตรา ๓๖ และมาตรา ๔๑ ของรัฐธรรมนูญแห่งราชอาณาจักรไทย บัญญัติให้กระทำได้โดยอาศัยอำนาจตามบทบัญญัติแห่งกฎหมาย นายกรัฐมนตรีและรัฐมนตรีว่าการกระทรวงยุติธรรมออกกฎกระทรวงไว้ ดังต่อไปนี้
