ไม้หวงห้ามมีสองประเภท คือ ประเภท ก. ไม้หวงห้ามธรรมดา ได้แก่ไม้ซึ่งการทำไม้จะต้องได้รับอนุญาตจาก พนักงานเจ้าหน้าที่หรือได้รับสัมปทานตามความในพระราชบัญญัตินี้ ประเภทข. ไม้หวงห้ามพิเศษ ได้แก่ไม้หายากหรือไม้ที่ควรสงวนซึ่งไม่อนุญาตให้ทำ ไม้ เว้นแต่รัฐมนตรีจะได้อนุญาตในกรณีพิเศษ
