เมื่อนายจ้างได้ประกาศใช้ข้อบังคับเกี่ยวกับการทำงานตามมาตรา ๑๐๘ แล้ว แม้ว่าต่อมานายจ้ งจะมีลูกจ้างลดต่ำกว่าสิบคนก็ตาม ให้นายจ้างยังคงมีหน้าที่ปฏิบัติตาม มาตรา ๑๐๘และมาตรา ๑๑๐ต่อไป
