เมื่อได้ประกาศโฆษณาตามมาตรา ๒๘แล้วถ้าปรากฏว่าคำขอรับสิทธิบัตรไม่ ชอบด้วยมาตรา ๕มาตรา ๙มาตรา ๑๐มาตรา ๑๑หรือมาตรา ๑๔ให้อธิบดีสั่งยกคำขอรับ สิทธิบัตรและให้พนักงานเจ้าหน้าที่แจ้งคำสั่งไปยังผู้ขอรับสิทธิบัตรรวมทั้งผู้คัดค้านในกรณีที่มีการ คัดค้านตามมาตรา ๓๑และให้ประกาศโฆษณาคำสั่งนั้นตามหลักเกณฑ์และวิธีการที่กำหนดโดย กฎกระทรวง
