การขอจดทะเบียนมูลนิธินั้น ให้ผู้ขอจัดตั้งมูลนิธิยื่นคำขอเป็น หนังสือต่อนายทะเบียนแห่งท้องที่ที่สำนักงานใหญ่ของมูลนิธิจะตั้งขึ้น ในคำขออย่ งน้อยต้องระบุ เจ้าของทรัพย์สินและรายการทรัพย์สินที่จะจัดสรรสำหรับมูลนิธิ รายชื่อ ที่อยู่และอาชีพของผู้จะ เป็นกรรมการของมูลนิธิทุกคน พร้อมกับแนบข้อบังคับของมูลนิธิมากับคำขอด้วย
