ถ้าภาระจำยอมแตะต้องเพียงส่วนหนึ่งแห่งภารยทรัพย์ เจ้าของ ทรัพย์นั้นอาจเรียกให้ย้ายไปยังส่วนอื่นก็ได้ แต่ต้องแสดงได้ว่าการย้ายนั้นเป็นประโยชน์แก่ตนและ รับเสียค่าใช้จ่าย ทั้งนี้ต้องไม่ทำให้ความสะดวกของเจ้าของสามยทรัพย์ลดน้อยลง
