ถ้ามิได้กำหนดไว้เป็นอย่างอื่นในนิติกรรมอันก่อให้เกิดสิทธิเก็บ กินไซร้ ท่านว่ ผู้ ทรงสิทธินั้นจะโอนการใช้สิทธิของตนให้บุคคลภายนอกก็ได้ ในกรณีเช่นนั้น เจ้าของทรัพย์สินอาจฟ้องร้องผู้รับโอนโดยตรง
