ค่าทดแทนตามมาตรา๑๕๒๓และมาตรา๑๕๒๔นั้น ให้ศาล วินิจฉัยตามควรแก่พฤติการณ์ โดยศาลจะสั่ งให้ชำระครั้งเดียวหรือแบ่งชำระเป็นงวดๆ มี กำหนดเวลาตามที่ศาลจะเห็นสมควรก็ได้ ในกรณีที่ผู้จะต้องชำระค่าทดแทนเป็นคู่สมรสของอีกฝ่ายหนึ่ง ให้ศาลคำนึงถึง จำนวนทรัพย์สิ ที่คู่สมรสนั้นได้รับไปจากการแบ่งสินสมรสเพราะการหย่านั้นด้วย
