ถ้าเจ้ามรดกมีภริยาที่ชอบด้วยกฎหมายก่อนใช้ประมวลกฎหมาย แพ่งและพาณิชย์บรรพ๕หลายคนยังมีชีวิตอยู่ ภริยาเหล่านั้นทั้งหมดรวมกันมีสิทธิได้รับมรดก ตามลำดับชั้นและส่วนแบ่งดั่งระบุไว้ในมาตรา ๑๖๓๕แต่ในระหว่างกันเองให้ภริยาน้อยแต่ละคน มีสิทธิได้รับมรดกกึ่งส่วนที่ภริยาหลวงจะพึงได้รับ
