อันการชำระหนี้นั้น ท่านว่าบุคคลภายนอกจะเป็นผู้ชำระก็ได้ เว้น แต่สภาพแห่งหนี้จะไม่เปิดช่องให้บุคคลภายนอกชำระ หรือจะขัดกับเจตนาอันคู่กรณีได้แสดงไว้ บุคคลผู้ไม่มีส่วนได้เสียด้วยในการชำระหนี้นั้น จะเข้าชำระหนี้โดยขืนใจลูกหนี้หา ได้ไม่
