ภูมิลำเนาของผู้เยาว์ ได้แก่ภูมิลำเนาของผู้แทนโดยชอบธรรมซึ่ ง เป็นผู้ใช้อำนาจปกครองหรือผู้ปกครอง ในกรณีที่ผู้เยาว์อยู่ใต้อำนาจปกครองของบิดามารดา ถ้ บิดาและมารดามี ภูมิลำเนาแยกต่างหากจากกัน ภูมิลำเนาของผู้เยาว์ได้แก่ภูมิลำเนาของบิดาหรือมารดาซึ่งตนอยู่ ด้วย
