ถ้าอสังหาริมทรัพย์ต้องศาลแสดงว่าตกอยู่ในบังคับแห่งภาระจำ ยอมโดยกฎหมายไซร้ ท่านว่าผู้ขายไม่ต้องรับผิด เว้นไว้แต่ผู้ขายจะได้รับรองไว้ในสัญญาว่ ทรัพย์สินนั้นปลอดจากภาระจำยอมอย่างใดๆทั้งสิ้น หรือปลอดจากภาระจำยอมอันนั้น
