ถึงแม้จะได้เรียกให้ลูกหนี้ชำระหนี้ดั่งกล่าวมาในมาตราก่อนนั้น แล้วก็ตาม ถ้าผู้ค้ำประกันพิสูจน์ได้ว่าลูกหนี้นั้นมีทางที่จะชำระหนี้ได้ และการที่จะบังคับให้ลูกหนี้ ชำระหนี้นั้นจะไม่เป็นการยากไซร้ ท่านว่าเจ้าหนี้จะต้องบังคับการชำระหนี้รายนั้นเอาจากทรัพย์สิน ของลูกหนี้่อน
