เมื่อบุคคลสองคนหรือกว่้นต่างได้จำนองทรัพย์ินแห่งตนเพื่อ ประกันหนี้แต่รายหนึ่งรายเดียวอันบุคคลอื่นจะต้องชำระและมิได้ระบุลำดับไว้ไซร้ ท่านว่าผู้จำนอง ซึ่งได้เป็นผู้ชำระหนี้ หรือเป็นเจ้าของทรัพย์สินซึ่งต้องบังคับจำนองนั้นหามีสิทธิจะไล่เบี้ยเอาแก่ผู้ จำนองอื่นๆต่อไปได้ไม่
