ตัวแทนผู้ใดตั้งตัวแทนช่วงตามที่ตัวการระบุตัวให้ตั้ง ท่านว่า ตัวแทนผู้นั้นจะต้องรับผิดแต่เพียงในกรณีที่ตนได้รู้ว่าตัวแทนช่วงนั้นเป็นผู้ที่ไม่เหมาะแก่การ หรือ เป็นผู้ที่ไม่สมควรไว้วางใจแล้วและมิได้แจ้งความนั้นให้ตัวการทราบหรือมิได้เลิกถอนตัวแทนช่วง นั้นเสียเอง
