ถ้านายหน้าทำการให้แก่บุคคลภายนอกด้วยก็ดี หรือได้รับคำมั่น แต่บุคคลภายนอกเช่นนั้นว่าจะให้ค่าบำเหน็จอันไม่ควรแก่ายหน้าผู้กระทำการโดยสุจริตก็ดีเป็น การฝ่าฝืนต่อการที่ตนเข้ารับทำหน้าที่ไซร้ ท่านว่านายหน้าหามีสิทธิจะได้รับค่าบำเหน็จหรือรับ ชดใช้ค่าใช้จ่ายที่ได้เสียไปไม่
