ถ้าโจทก์ขาดนัดพิจารณา ให้ศาลมีคำสั่งจำหน่ายคดีน้ันเสียจากสารบบความ เว้นแต่จำเลยจะได้แจ้งต่อศาลในวันสืบพยานขอให้ดำเนินการพิจารณาคดีต่อไป ก็ให้ศาลพิจารณาและชี้ขาดตัดสิน คดีนั้นไปฝ่ายเดียว
