ผู้ใดเป็นเจ้าพนักงานมีหน้าที่รักษาหรือใช้ดวงตราหรือรอยตราของ ราชการหรือของผู้อื่น กระทำการอันมิชอบด้วยหน้าที่ โดยใช้ดวงตราหรือรอยตรานั้น หรือโดยยินยอม ให้ผู้อื่นกระทำเช่นนั้น ซึ่งอาจทำให้ผู้อื่นหรือประชาชนเสียหายต้องระวางโทษจำคุ ไม่เกินห้าปี หรือ ปรับไม่เกินหนึ่งหมื่นบาท หรือทั้งจำทั้งปรับ
