คนต่างด้าวได้มาซึ่งที่ดินโดย กรณีรับมรดก ได้รับมรดกในฐานะที่เป็นทายาทโดยธรรมรัฐมนตรี จะอนุญาตให้ได้มาซึ่งที่ดินนั้น แต่เมื่อรวมกับที่มีอยู่ แล้วไม่เกินจำนวนที่จะพึงมีได้ตามความในมาตรา๘๗ ก็ได้
