การพิจารณาพิพากษาอรรถคดีเป็นอำนาจของศาล ซึ่งต้องดำเนินการให้เป็นไป ตามกฎหมาย และในพระปรมาภิไธยพระมหากษัตริย์ ผู้พิพากษาและตุลาการย่อมมีอิสระในการพิจารณาพิพากษาอรรถคดีตามรัฐธรรมนูญและกฎหมาย ให้เป็นไปโดยรวดเร็ว เป็นธรรม และปราศจากอคติทั้งปวง
