ผู้ใดทำการบำบัดรักษาผู้ติดยาเสพติดเป็นปกติธุระ โดยมิได้กระทำใน สถานพยาบาลยาเสพติดหรือสถานฟื้นฟูสมรรถภาพผู้ติดยาเสพติดตามที่กำหนดในประมวลกฎหมายนี้ ไม่ว่าจะได้รับประโยชน์ตอบแทนหรือไม่ อันเป็นการฝ่าฝืนมาตรา ๑๒๑ ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินสามแสนบาท หรือทั้งจำทั้งปรับ
