เมื่อมีผู้ยื่นหนังสือขอให้ศาลพิจารณาวินิจฉัย และศาลเห็นว่าเป็นกรณีที่ต้อง ด้วยมาตรา ๔๑ วรรคสอง (๑) (๒) (๓) (๔) (๕) (๖) (๗) (๘) หรือ

(๙) ให้ศาลรับไว้พิจารณาและ ดำเนินการต่อไป
