ในกรณีที่มีเหตุพิเศษ ผู้บังคับบัญชาซึ่งมีอำนาจสั่งบรรจุและแต่งตั้ง ตามมาตรา ๑๕ อาจคัดเลือกบรรจุบุคคลเข้ารับราชการและแต่งตั้งให้ดำรงตำแหน่งโดยไม่ต้อง ดำเนินการสอบแข่งขันตามมาตรา ๑๐ ก็ได้ ทั้งนี้ ตามที่กระทรวงกลาโหมกำหนด
