ข้อ ๒ ผู้ขอรับใบอนุญาตต้องมีคุณสมบัติและไม่มีลักษณะต้องห้ามตามที่กำหนดไว้ในมาตรา ๔๖ และมาตรา ๔๗ และต้องได้รับใบอนุญาตก่อสร้างสถานประกอบการทางนิวเคลียร์หรือได้รับโอน ใบอนุญาตก่อสร้างสถานประกอบการทางนิวเคลียร์แล้ว
