ข้อ ๒๑ ผู้ยื่นคำขอรับใบอนุญาตผลิตสุรากลั่นชนิดสุราสามทับที่ผลิตเพื่อส่งออกไปนอกราชอาณาจักร หรือผู้ยื่นคำขอรับใบอนุญาตผลิตสุรากลั่นชนิดสุราสามทับที่ผลิตเพื่อนำไปใช้ในการผลิตน้ำมันเชื้อเพลิง และการประกอบกิจการอุตสาหกรรม ต้องเป็นนิติบุคคลประเภทบริษัทจำกัดหรือบริษัทมหาชนจำกัด ที่จัดตั้งขึ้นตามกฎหมายไทย เล่ม ๑๔๒ ตอนที่ ๗๙ ก ราชกิจจานุเบกษา ๒ ธันวาคม ๒๕๖๘
