เมื่ อได้ทำการทดสอบการเดินรถขนส่งทางรางแล้ว ก่อนเปิดให้บริการแก่ ประชาชนต้องได้รับอนุญาตจากอธิบดีว่า โครงสร้างของรางและทรัพย์สินที่ใช้ในการประกอบกิจการ ขนส่งทางรางมีสภาพที่สามารถใช้งานได้อย่างปลอดภัยและเป็นไปตามมาตรฐานที่กำหนดในกฎกระทรวง ที่ออกตามมาตรา ๑๓ (๓)
