ในกรณีของที่ริบได้เนื่องจากการกระทำความผิดตามพระราชบัญญัตินี้มิได้เป็น ของผู้กระทำความผิด ให้ศาลมีอำนาจสั่งริบได้ถ้าเจ้าของนั้นรู้หรือมีเหตุอันควรสงสัยว่ามีหรือจะมี การกระทำความผิด แต่มิได้กระทำการใดเพื่อมิให้เกิดการกระทำความผิดหรือแก้ไขมิให้การกระทำนั้น บรรลุผล หรือมิได้ระมัดระวังมิให้ของนั้นไปเกี่ยวข้องกับการกระทำความผิด
