กรณีที่คดีส่งข้ามแดนอยู่ในระหว่างการพิจารณาของศาลไม่ว่าในศาลใด หากบุคคลซึ่งถูกร้องขอให้ส่งข้ามแดนแสดงต่อศาลว่ายินยอมให้ส่งข้ามแดน ให้ศาลงดการพิจารณาและ มีคำสั่งให้ขังบุคคลนั้นไว้เพื่อส่งข้ามแดนตามมาตรา ๒๒ต่อไป ความยินยอมที่ได้กระทำต่อหน้าศาลแล้วไม่อาจเพิกถอนได้
