ที่ราชพัสดุที่ยังไม่ได้ใช้เพื่อประโยชน์ในทางราชการของส่วนราชการหรือ องค์กรปกครองส่วนท้องถิ่น หรือที่ราชพัสดุที่อยู่ในความครอบครองของส่วนราชการหรือองค์กรปกครอง ส่วนท้องถิ่นแต่ส่วนราชการหรือองค์กรปกครองส่วนท้องถิ่นนั้นยังไม่ได้ใช้ประโยชน์ กระทรวงการคลัง สามารถนำมาจัดหาประโยชน์ได้ ทั้งนี้ ให้เป็นไปตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่กำหนดใน กฎกระทรวง
