ให้คณะกรรมการพิจารณาคำร้องขอตามมาตรา ๓๒ แล้วเสนอความเห็นต่อ รัฐมนตรีเพื่อพิจารณาวินิจฉัย ทั้งนี้ ต้องแจ้งคำวินิจฉัยให้ผู้ยื่นคำร้องขอทราบภายในหนึ่งร้อยแปดสิบวัน นับแต่วันที่ได้รับคำร้องขอ คำวินิจฉัยของรัฐมนตรีให้เป็นที่สุด
