หากการช่วยเหลือกู้ภัยจำเป็นต้องมีขึ้นหรือต้องยากขึ้นเพราะความผิดหรือการละเลย ต่อหน้าที่ของผู้ช่วยเหลือกู้ภัย ผู้ช่วยเหลือกู้ภัยนั้นอาจเสียสิทธิในการได้รับเงินตอบแทนไปทั้งหมดหรือ บางส่วน หากผู้ช่วยเหลือกู้ภัยกระทำการโดยกลฉ้อฉลหรือไม่สุจริต ย่อมสิ้นไปซึ่งสิทธิที่จะได้รับเงิน ตอบแทนโดยสิ้นเชิง
