ภายใต้บังคับของบทบัญญัติแห่งประมวลกฎหมายวิธีพิจารณาความอาญา ว่าด้วยการอภัยโทษ การเปลี่ยนโทษหนักเป็นเบา และลดโทษ ผู้ต้องขังมีสิทธิที่จะยื่นคำร้องทุกข์ หรือเรื่องราวใดๆ ต่อเจ้าพนักงานเรือนจำ ผู้บัญชาการเรือนจำ อธิบดี รัฐมนตรี หรือหน่วยงานของรัฐ ที่เกี่ยวข้อง หรือทูลเกล้าฯ ถวายฎีกาต่อพระมหากษัตริย์ได้ ทั้งนี้ ตามหลักเกณฑ์ วิธีการ และเงื่อนไข ที่กำหนดในกฎกระทรวง
