สิ่งของต้องห้ามตามความในมาตรา ๗๒ และมาตรา ๗๓ ไม่หมายความรวมถึง สิ่งของซึ่งมีไว้เพื่อใช้ในราชการ สิ่งของต้องห้ามที่มีการฝ่าฝืนมาตรา ๗๒ หรือมาตรา ๗๓ ให้ริบเสียทั้งสิ้น ในกรณีสิ่งของต้องห้ามตามมาตรา ๗๓ หากไม่มีการดำเนินการฟ้องร้องตามกฎหมาย ให้ผู้บัญชาการเรือนจำมีอำนาจดำเนินการกับสิ่งของต้องห้ามดังกล่าว ตามหลักเกณฑ์ วิธีการ และเงื่อนไข ที่กำหนดในกฎกระทรวง
