ในกรณีท่ี ศาลรัฐธรรมนูญเห็นว่าเรื่องใดหรือประเด็นใดที่ได้มีการเสนอให้ ศาลรัฐธรรมนูญพิจารณา เป็นเรื่องหรือประเด็นที่ศาลรัฐธรรมนูญได้เคยพิจารณาวินิจฉัยแล้ว ศาลรัฐธรรมนูญจะไม่รับเรื่องหรือประเด็นดังกล่าวไว้พิจารณาก็ได้
