ในระหว่างที่ตุลาการศาลรัฐธรรมนูญพ้นจากตำแหน่งก่อนวาระและยังไม่มี การแต่งตั้งตุลาการศาลรัฐธรรมนูญแทนตำแหน่งที่ว่าง ให้ตุลาการศาลรัฐธรรมนูญเท่าที่เหลืออยู่ปฏิบัติหน้าที่ ต่อไปได้ บทบัญญัติตามวรรคหนึ่งมิให้ใช้บังคับกรณีมีตุลาการศาลรัฐธรรมนูญเหลืออยู่ไม่ถึงเจ็ดคน
