เด็กที่พึงได้รับการคุ้มครองสวัสดิภาพได้แก่

(๑) เด็กที่ถูกทารุณกรรม

(๒) เด็กที่เสี่ยงต่อการกระทำผิด

(๓) เด็กที่อยู่ในสภาพที่จำต้องได้รับการคุ้มครองสวัสดิภาพตามที่กำหนดในกฎกระทรวง
