ผู้ตรวจการแผ่นดินมีวาระการดำรงตำแหน่งเจ็ดปีนับแต่วันที่พระมหากษัตริย์ ทรงแต่งตั้ง และให้ดำรงตำแหน่งได้เพียงวาระเดียว ในกรณีที่ผู้ตรวจการแผ่นดินพ้นจากตำแหน่งตามวาระ ให้ผู้ตรวจการแผ่นดินที่พ้นจากตำแหน่ง ปฏิบัติหน้าที่ต่อไปจนกว่าจะมีการแต่งตั้งผู้ตรวจการแผ่นดินใหม่แทน
