เมื่อศาลพิพากษาว่าจำเลยมีความผิดแต่รอการกำหนดโทษหรือรอการลงโทษไว้ ไม่ว่าจะมีคำขอหรือไม่ ศาลอาจนำวิธีการเพื่อความปลอดภัยตามมาตรา ๓๙ (๓) และ
