ข้อ ๔ การประมูลคลื่นความถี่เพื่อกิจการโทรคมนาคมตามคำสั่งนี้ ไม่เป็นการตัดสิทธิของ หน่วยงานของรัฐในการเรียกร้องค่าเสียหายหรือค่าใช้จ่ายอื่นอันเกิดจากการประมูลคลื่นความถี่ย่าน ๙๐๐ MHz ตามประกาศคณะกรรมการกิจการกระจายเสียง กิจการโทรทัศน์ และกิจการโทรคมนาคม แห่งชาติ เรื่อง หลักเกณฑ์และวิธีการอนุญาตให้ใช้คลื่นความถี่สำหรับกิจการโทรคมนาคม ย่าน ๘๙๕ - ๙๑๕ MHz/๙๔๐ - ๙๖๐ MHz
