ผู้ต้องขังซึ่งได้รับบาดเจ็บ เจ็บป่วย หรือตาย เนื่องจากการงานตามมาตรา ๔๘ หรือมาตรา ๔๙ มีสิทธิได้รับเงินทำขวัญตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่กำหนดในกฎกระทรวง ในกรณีที่ผู้ต้องขังซึ่งมีสิทธิได้รับเงินทำขวัญตามวรรคหนึ่งตาย ให้จ่ายเงินทำขวัญนั้นแก่ทายาท
