ตรี ผู้ใดฝ่าฝืนมาตรา ๓๙เบญจวรรคหนึ่ง ต้องระวางโทษจำคุก ไม่เกินสามเดือน หรือปรับไม่เกินหกหมื่นบาทหรือทั้งจำทั้งปรับ นอกจากระวางโทษตามวรรคหนึ่งแล้วผู้ฝ่าฝืนมาตรา ๓๙เบญจวรรคหนึ่ง ยัง ต้องระวางโทษปรับอีกวันละไม่เกินหนึ่งหมื่นบาทจนกว่าจะได้ปฏิบัติให้ถูกต้อง
