ให้ผู้ที่ได้รับใบอนุญาตเป็นผู้มีสิทธิทำรายงานเกี่ยวกับการศึกษาและ มาตรการป้องกันและแก้ไขผลกระทบกระเทือนต่อคุณภาพสิ่งแวดล้อมอยู่แล้วตามพระราชบัญญัติ ส่งเสริมและรักษาคุณภาพสิ่ งแวดล้อมแห่งชาติ พ.ศ. ๒๕๑๘เป็นผู้มีสิทธิทำรายงานผลกระทบ สิ่งแวดล้อมตามพระราชบัญญัตินี้ได้ต่อไป ทั้งนี้ จนกว่ารัฐมนตรีจะกำหนดให้ผู้นั้นมาดำเนินการขอ อนุญาตตามพระราชบัญญัตินี้
