ผู้ใดครอบครองป่าที่ได้ถูกแผ้วถางโดยฝ่าฝืนต่อบทบัญญัติแห่งมาตรา ก่อน ให้สันนิษฐานไว้ก่อนว่าบุคคลนั้นเป็นผู้แผ้วถางป่านั้น
