ผู้ใดครอบครองใบหุ้นกู้ ใบสำคัญแสดงสิทธิที่จะซื้อหุ้น หรือใบสำคัญ แสดงสิทธิที่จะซื้อหุ้นกู้ชนิดระบุชื่อผู้ถือที่ออกตามมาตรา ๓๓หรือมาตรา ๓๔ที่มีการสลักหลังตาม มาตรา ๕๑แล้วให้สันนิษฐานไว้่อนว่าผู้นั้นเป็นเจ้าของหลัทรัพย์นั้น
