ถ้าจำนำตราสารชนิดออกให้แก่บุคคลเพื่อเขาสั่ง ท่านห้ามมิให้ ยกขึ้นเป็นข้อต่อสู้บุคคลภายนอกเว้นแต่จะได้สลักหลังไว้ที่ตราสารให้ปรากฏการจำนำเช่นนั้น อนึ่ง ในการนี้ไม่จำเป็นต้องบอกกล่าวแก่ลูกหนี้แห่งตราสาร
