ถ้ ผู้รับรองตั๋วเงินซึ่งออกเป็สำรับใช้เงินไปโดยมิได้เรียกให้ส่ง มอบคู่ฉีกฉบับซึ่งมีคำรับรองของตนนั้นให้แก่ตนและในเวลาตั๋วเงินถึงกำหนด คู่ฉีกฉบับนั้นไปตก อยู่ในมือผู้ทรงโดยชอบด้วยกฎหมายคนใดคนหนึ่งไซร้ ท่านว่าผู้รับรองจะต้องรับผิดต่อผู้ทรงคู่ฉีก ฉบับนั้น
