ทวิ ผู้ใดฝ่าฝืนมาตรา ๑๒ทวิ ต้องระวางโทษจำคุกไม่เกินสองปี และ ปรับไม่เกินสองแสนบาท ในกรณีผู้กระทำความผิดตามวรรคหนึ่งเป็นนิติบุคคล กรรมการผู้จัดการ ผู้จัดการ หรือผู้แทนของนิติบุคคลนั้น ต้องรับโทษตามที่บัญญัติไว้ในวรรคหนึ่งด้วย เว้นแต่จะพิสู จน์ได้ว่า ตน มิได้มีส่วนในการกระทำความผิดของนิติบุคคลนั้น
