ผู้ใดฝ่าฝืนมาตรา ๙๕ วรรคหนึ่ง หรือมาตรา ๑๐๔ต้องระวางโทษจำคุก ตั้งแต่หนึ่งปีถึงสิบปี และปรับตั้งแต่สองหมื่นบาทถึงสองแสนบาท และให้ศาลสั่งเพิกถอนสิทธิเลือกตั้ง ของผู้นั้นมีกำหนดยี่สิบปี
