ในกรณีที่ปรากฏว่ามีการกระทำความผิดตามพระราชบัญญัติประกอบรัฐธรรมนูญนี้ เกิดขึ้นในเขตเลือกตั้งใด ให้ถือว่าผู้สมัครหรือพรรคการเมืองที่ส่งสมาชิกของตนลงสมัครรับเลือกตั้ง ในเขตเลือกตั้งนั้นเป็นผู้เสียหายตามประมวลกฎหมายวิธีพิจารณาความอาญา
