หากคณะกรรมการพิจารณาอุทธรณ์ไม่พิจารณาอุทธรณ์ให้แล้วเสร็จภายใน กำหนดเวลาตามมาตรา ๔๑ วรรคหนึ่ง ผู้นำของเข้าหรือผู้ส่งของออกมีสิทธินำคดีไปฟ้องต่อศาลได้ ในกรณีที่ผู้นำของเข้าหรือผู้ส่งของออกนำคดีไปฟ้องต่อศาล ให้คณะกรรมการพิจารณาอุทธรณ์ ยกอุทธรณ์ของผู้นำของเข้าหรือผู้ส่งของออกนั้น
